A probation violation hearing for former state Supreme Court Justice Joan Orie Melvin is scheduled for next week.
The October 15th hearing before Judge Lester Nauhaus is because Melvin has not yet written notes of apology that were requirements of her sentence. Melvin's attorneys say making her send out the letters would be unfair while she appeals her conviction.
Melvin has obtained a temporary stay on the letter-writing part of the sentence, but that led prosecutors to counter that if she doesn't write the letters she should be re-sentenced to possible jail time.
Melvin is appealing her sentence of three years' house arrest on charges that she illegally used her former Superior Court staff and the state-paid staff of her sister to work on political campaigns.
