Residents of six Pennsylvania state House districts that aren't currently represented because their lawmakers have been elected to other offices are asking the state Supreme Court to force special elections to be held alongside the April 24th primary.
Attorney Kevin Greenberg said Tuesday that the high court gave House Speaker Sam Smith and Secretary of State Carol Aichele until Wednesday to file an answer to his lawsuit that says Smith's failure to act constitutes a "dereliction of duty."
Smith says he's powerless to act until the Legislative Reapportionment Commission passes a legal redistricting plan, and the Supreme Court approves it.
The commission is meeting Wednesday in Harrisburg, and could vote on new district lines for the House and Senate at that time.
