Former Penn State University president Graham Spanier, facing perjury charges in the Jerry Sandusky sex abuse investigation, wants a judge to dismiss the charges against him.
Spanier faces obstruction of justice, perjury, endangering the welfare of children and other counts.
Spanier's attorneys filed a motion for dismissal Monday, saying said prosecutors improperly relied on testimony of former university counsel Cynthia Baldwin in making their case against him.
They contend that Spanier thought Baldwin was his lawyer when he testified before the Sandusky grand jury, and her testimony can't be used against Spanier.
Spanier's attorneys filed a separate motion in Dauphin County Court on Monday seeking a delay in the Dec. 13 preliminary hearing.
