The State Supreme Court has denied a request from Blair County District Attorney Richard Consiglio to reconsider its decision upholding a Superior Court order granting a new trial for Paul Ross, for the 2004 murder of a Hollidaysburg woman.
The case will now head back to Blair County for a retrial at which time the death penalty will be sought.
In the original trial, Ross was found guilty of first-degree murder of 26 year old Tina Miller. The jury recommended life in prison citing the defendant’s dysfunctional childhood.
Two years ago a Superior Court panel ordered a new trial for Ross.
Ross’s attorney had appealed the conviction arguing he was denied time to prepare a proper defense and that a judge should not have allowed three former girlfriends of Ross to testify about his propensity for physical and sexual abuse.
The Superior Court panel cited both issues as reasons for the new trial.
